THE AGREEMENT BETWEEN US

Terms of Service

These terms govern the Tessa’s Family Platform, including Closet, Pantry, Garage, Vanity, Cabinet, household profiles, Locations, AI features and related services.

Plain-English note: you keep ownership of your content. We receive only the narrow permission needed to run the feature you choose; we do not gain a right to sell your personal information, build advertising profiles from it or use private images for unrelated commercial purposes.

1. Agreement and eligibility

By creating an account, purchasing a membership or using Tessa’s Closet, you agree to these Terms, the Privacy Policy, and any policy that applies to a feature you use. If you do not agree, do not use the service.

You must be at least 18 years old and legally able to enter a contract. Tessa’s Closet is intended for adults and is not directed to children under 13.

These Terms are an agreement between you and Tessa’s Closet LLC, an Arizona limited liability company. Electronic acceptance has the same effect as a handwritten signature.

2. Your account and sign-in

You are responsible for activity under your account, for keeping access to your sign-in method secure, and for providing accurate information. Tell us promptly at hello@tessascloset.com if you believe your account is being misused.

One account may provide household access to Closet, Pantry, Garage, Vanity and Cabinet through an individual-app or All Access membership. You may sign in with Email, Google, or ChatGPT. Shared identity and household coordination do not make private family content visible to business administrators. Third-party sign-in providers have their own terms and privacy practices.

Household profiles and permissions

An adult account owner may create and manage household profiles for people and pets, set permissions, assign personal or shared items, edit or reassign items, manage human Fit Profiles and pet care profiles, archive or restore non-primary members, coordinate plans, and choose which entitled modules appear for the household. Hiding a module does not delete its saved records. The account owner is responsible for the accuracy of profile information, obtaining any required permission from other people, and limiting access appropriately. Household profiles do not create separate contracts or independent ownership of the account.

Private birth dates, gender choices, measurements, fit preferences, pet identification, veterinarian contact, feeding instructions, allergies, medication-care notes and equipment details are optional organizational information. Age- and gender-adapted human questions and pet-care fields are organizational aids, not statements about identity, health, development or veterinary treatment. Comfort Mode is an optional planning aid, not medical advice or a diagnosis. Review fit, food and animal-care choices using your own judgment and follow product labels and qualified veterinary guidance.

3. What the service does

The service may organize family wardrobes, food, pet food and treats, makeup, personal care, human and pet medicines, first aid, tools, pet equipment, vehicles, seasonal storage and household locations; save quantities, expiration dates, ratings, fit notes, feeding and care notes, wear and maintenance history; preserve tagged events; suggest outfits and meals; create family and pet packing and shopping ideas; provide weather-aware recommendations; track warranties and lending; prepare catalog images; search across household records; maintain a shared Shopping List; help someone find an item through a human-readable home or off-property storage path; assist with resale; and generate optional AI previews. Features may change as the beta develops.

Empty / Missing, Need, In Cart and Put Away are inventory states and planning cues. They do not prove that an item was purchased, consumed, lost, expired, appropriate or safely stored. Ratings and notes are personal preference signals and do not guarantee a result.

VERIFY BEFORE RELYING

AI, cameras, labels, screen settings and incomplete records can produce mistakes. Verify actual fit, product identity, food and pet-food safety, human or pet medicine label facts, expiration, quantity, tool and pet-equipment condition, vehicle needs, storage contents and maintenance requirements before relying on a saved record or suggestion.

4. Device-local content and backups

Private Closet, Pantry, Garage, Vanity, Cabinet and Location images, body-reference photos and saved try-on images are designed to remain in storage controlled by your browser or device, except for a reduced working copy deliberately submitted for an AI action or a seller photo deliberately published. Tessa’s Closet cannot recover device-only images if you clear browser data, remove the Home Screen app, replace or lose the device, use a private-browsing session, or experience device/storage failure.

You are responsible for maintaining any personal backup you want. We do not promise that browser storage will function like Apple Photos, iCloud or a permanent backup service.

5. Your content and limited permission

You keep ownership of content you provide. You grant us only the limited, non-exclusive permission reasonably needed to operate the feature you select. For account-synced text and garment details, that means securely storing and displaying them to you. For a seller photo you deliberately publish, that means hosting, resizing and displaying it to marketplace users until the listing or required retention period ends.

This permission does not allow us to sell your personal information, use private images for advertising, or repurpose your private closet for an unrelated commercial product. You represent that you have the right to upload and publish your content and that it does not violate another person’s privacy, publicity, copyright, trademark or other rights.

6. AI, image intake, Look Studio and Cabinet Guide

AI features are optional and may produce inaccurate, incomplete or unrealistic results. Product isolation, label reading, mixed-purchase classification, outfit, makeup and meal suggestions, and virtual previews all require review. They are organizational or creative aids—not tailoring, sizing, food-safety, medical, body-assessment, compatibility, shade-match or purchase guarantees.

YOU REMAIN THE DECISION-MAKER

Never rely on AI as the only source for a decision involving health, safety, allergies, food, medicine, skin, children, pets, tools, vehicles, money, travel or an emergency. Inspect the real item and use the current label, manufacturer instructions and qualified professional guidance.

Vanity AI Look Studio uses saved product and outfit details first and may process an optional outfit photo or adult portrait only after the member selects that action. AI Mirror is a creative visualization. It does not guarantee exact color, texture, wear, skin compatibility or outcome and must not be used for skin diagnosis or cosmetic-procedure simulation.

Cabinet Guide is a conservative inventory and label-review aid. It may screen entered words for possible emergency warning signs and may surface an eligible non-prescription product only so an adult can reread the current physical label or ask a pharmacist. It does not diagnose, prescribe, select or combine medicines, calculate a dose, verify interactions, confirm a prescription, or guarantee accuracy or safety. Prescription products are never suggested. Allergy information and saved label facts may be incomplete or outdated; the current physical label, pharmacist, clinician, Poison Control and emergency services govern. Call 911 for a medical emergency in the United States and call Poison Control at 1-800-222-1222 for a possible poisoning or overdose.

To the fullest extent allowed by law, you accept the risks of using AI output and remain responsible for what you enter, what you choose to do, what you give another person or pet, and any decision made after ignoring a warning, label, contraindication, allergy, expiration, professional instruction or emergency direction. You must not use the service to practice medicine, pharmacy, nutrition, veterinary care, cosmetology, vehicle repair or another regulated profession without the licenses and judgment the law requires.

When you choose an AI feature, the images, symptoms, profile fields and instructions selected for that request may be transmitted through a protected endpoint to an AI service provider for processing. Review the Privacy Policy for details.

7. Acceptable use

You may not misuse the service, attempt unauthorized access, scrape or copy other members’ information, upload malware, evade fees, impersonate others, infringe rights, harass users, create deceptive listings, or use AI features to create sexual, exploitative, defamatory or unlawful content. You may not upload another person’s body or face without their permission.

You also may not intentionally provide false allergy, symptom, label, identity, ownership or safety information; bypass a warning or eligibility block; use Cabinet Guide for diagnosis, dosing, drug interaction or prescription decisions; or use any suggestion contrary to a current package label, recall, manufacturer instruction or professional direction.

8. Payments and marketplace

Paid memberships are governed by the Subscription Terms. Local exchanges are governed by the Marketplace Terms. Stripe processes membership billing only. Tessa’s does not process, hold, guarantee or charge a fee on Marketplace payments.

Tessa’s does not display third-party advertising, sponsored results or affiliate links. A member listing in the optional marketplace and a retailer link deliberately opened from a member’s own Shopping List are user-requested functions, not endorsements or paid placement.

9. Changes, suspension and termination

We may update, suspend or discontinue features; take action against accounts that violate these Terms; or preserve information when reasonably required for security, fraud prevention, disputes or law. When practical, we will provide notice of material changes.

You may stop using the service and cancel a paid membership at any time. Cancellation and account-data deletion are different actions; see the Subscription and Privacy Policies.

10. Disclaimers and liability

To the fullest extent allowed by law, the service is provided “as is” and “as available.” We do not warrant uninterrupted operation, exact AI results, exact weather data, garment authenticity, seller performance, buyer performance, item condition or a particular resale result.

Without limiting the above, we do not warrant that a record, alert, search result, recommendation or AI output is complete, current, accurate, safe, appropriate for a particular person or pet, compatible with another product, or a substitute for the actual item, current label, recall notice, manufacturer, pharmacist, clinician, veterinarian or emergency service.

To the fullest extent allowed by law, Tessa’s Closet will not be liable for indirect, incidental, special, consequential or punitive damages. Our aggregate liability arising from the service will not exceed the greater of $100 or the amount you paid Tessa’s Closet for membership during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

11. Assumption of risk, release and responsibility for misuse

You voluntarily choose whether to use each feature. To the fullest extent allowed by law, you assume responsibility for decisions and actions based on app records, suggestions or AI output, including harm caused by inaccurate inputs, outdated inventory, failure to inspect a physical item, improper storage, unsafe food, an allergic reaction, misuse of medicine, cosmetic irritation, tool or vehicle misuse, pet-care decisions, lost device-only media, or use contrary to these Terms and in-product warnings.

You agree to reimburse and defend Tessa’s Closet LLC, its owners, personnel and service providers against third-party claims, losses and reasonable costs caused by your unlawful content, infringement, fraud, marketplace conduct, unauthorized use of another person’s information, or intentional misuse of the service. This obligation does not apply to the extent a claim was caused by conduct for which liability cannot legally be limited.

12. Governing law and disputes

These Terms are governed by Arizona law, without regard to conflict-of-law principles. Before filing a claim, you and Tessa’s Closet agree to try in good faith for 30 days to resolve it by contacting hello@tessascloset.com. Any court proceeding will be brought in a court with jurisdiction in Maricopa County, Arizona, unless consumer law requires otherwise.

13. General terms

If one provision is unenforceable, the remaining provisions stay effective and the invalid provision will be limited to the minimum extent required. Our failure to enforce a provision is not a waiver. Provisions concerning content rights, payment, responsibility, disclaimers, liability, disputes and records survive termination where their nature requires.

These Terms and the policies they incorporate are the entire agreement about the service unless a separate written agreement applies. We may update them as the service and law change; we will provide additional notice and renewed consent when legally required.
